This case I think a little more attention. The change gained for the colonial authorities of HK. made by the Mary, in which 2d C. should seem to concur is that Kary acted in sanctioning the police tops on board the Maddison without a warrant. I think directions as to his duty, in that particular: but I should like in the first instance to have a statement made how the facts actually stand with reference to this point.

I have gone over all the correspondence on this subject, & now annex Extracts therefrom of so much as has been said on the point of the police acting without a warrant. You will notice the Ordinance under the authority of which the Police acted. I also annex an extract from the L.O. sending the opinion of the Lawer's Advocate Mr. Merivale with reference to St. Lucia's dept. of the Crown to Governor sending & perhaps in a mild caution to the course of the Colonial Foreign Office Authorities in these questions of 8 May 70724 upon a case in one of the West India Colonies resembling this at St. Kong.
I have been unable to procure this Letter before.
